1.1. These terms and conditions apply to purchases made from the MagliaModa online store (at www.magliamoda.com).

1.2. The seller of the goods is OÜ Amedeo (registry code: 12180125, address: Maakri tn 36-55, 10145 Tallinn, Estonia), hereinafter referred to as the Seller.

1.3. These terms govern the legal relationship arising between the client (hereinafter the Purchaser) and the Seller when purchasing goods via the online store.

1.4. In addition to these terms, the legal relationships arising from the purchase of products from the online store are regulated by the legislation valid in the Republic of Estonia (including the Law of Obligations Act and the Consumer Protection Act).

2.1. All prices displayed in the online store are in euros (€) and include VAT.

2.2. A delivery fee may be added to the price depending on the delivery method selected by the Purchaser. The delivery cost is displayed in the shopping cart before the order is finalized.

3.1. To order goods, the desired products must be added to the shopping cart. To finalize the order, the required data fields must be filled in and a suitable delivery method chosen.

3.2. The amount payable will then be displayed on the screen, which can be paid via a bank link or another payment solution.

3.3. The contract enters into force from the moment the amount due is transferred to the Seller’s bank account.

3.4. If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the Purchaser will be informed as soon as possible, and the money paid (including delivery costs) will be refunded immediately, but no later than within 14 days of sending the notice.

4.1. Goods are shipped to all European Union member states.

4.2. Delivery options depend on the delivery address entered by the Purchaser. Final delivery methods and prices are displayed in the shopping cart before the order is finalized.

4.3. Shipments generally reach the destination specified by the Purchaser within the delivery times specified in the online store from the entry into force of the sales contract.

5.1. 14-day statutory right of withdrawal: After receiving the order, the Purchaser has the right to withdraw from the contract entered into in the online store within 14 days.

5.2. 30-day extended return right: MagliaModa offers an extended return period of up to 30 days as an additional benefit.

• During the first 14 days, statutory withdrawal conditions apply (the Purchaser has the right to examine and try on the product).
• During the period from the 15th to the 30th day, the right of return applies only if the goods are completely unused, with tags attached, and in the original packaging.

5.3. Examining the goods: To exercise the right of withdrawal and return the goods, the Purchaser may not use the product in any other way than is necessary to verify the nature, characteristics, and functioning of the goods (i.e., in the manner permitted for testing the goods in a physical store).

5.4. Diminished value: If the goods have been used for purposes other than those necessary to verify the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the Seller has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.

5.5. To return the goods, a statement of withdrawal (free form or the online store’s return form) must be submitted and sent to the e-mail address info@magliamoda.com no later than within 14 days of receipt of the goods (or within 30 days in the case of the extended right).

5.6. The cost of returning the goods is borne by the Seller. Returns are free for the Purchaser.

5.7. Upon receipt of the withdrawal application, the Seller shall return to the Purchaser all payments received from the Purchaser under the contract immediately but no later than after 14 days. The Seller may refuse to make refunds until the item which is the object of the contract has been returned or until the Purchaser has provided proof that the item has been returned.

6.1. The Seller is responsible for the non-compliance of goods sold to the Purchaser with the terms of the contract or for defects which existed at the time of delivery and which occur within up to two years from the delivery of the goods to the Purchaser.

6.2. Within the first one year of delivery of the thing to the Purchaser, it is presumed that the defect already existed at the time of delivery. Rebuttal of this presumption is the responsibility of the Seller.

6.3. In the event of a defect, the Purchaser has the right to contact the Seller no later than within two months by sending an e-mail to: info@magliamoda.com.

6.4. The Seller is not liable for defects that have arisen after the delivery of the goods to the Purchaser (e.g., due to incorrect care of the product, normal wear and tear).

6.5. If the Seller refuses to resolve the Purchaser’s complaint or the Purchaser does not agree with the solution offered by the Seller and finds that their rights have been violated, the Purchaser has the right to file a complaint with the Consumer Disputes Committee.

7.1. The Seller uses the personal data entered by the Purchaser (including name, telephone number, address, e-mail address, bank details) only to process the order and send the goods to the Purchaser.

7.2. The Seller forwards personal data to the transport service provider in order to deliver the goods.

7.3. The Seller sends newsletters and offers to the Purchaser’s e-mail address only if the Purchaser has expressed a wish to receive them by entering an e-mail address on the website and indicating their desire to receive direct mail notifications.

8.1. If the Purchaser has any complaints regarding the online store, they must be sent to the e-mail address info@magliamoda.com or submitted by calling +372 53031311.

8.2. If the Purchaser and the Seller cannot resolve the dispute by agreement, the Purchaser may contact the Consumer Disputes Committee operating under the Consumer Protection and Technical Regulatory Authority. Procedural conditions can be viewed and applications submitted here.
